A Quick Word Before You Order
These Store Terms & Conditions explain how purchases from the Hey Uncle Tuck Store work. The store is operated by Lindsey Epps Media LLC. By placing an order, you agree to these terms, along with our Privacy Policy and the general Hey Uncle Tuck Terms of Use.
- Store and Eligibility
You must be legally able to enter into a binding agreement in your location to place an order. You agree that the information you provide at checkout is accurate, current, and complete.
- Products and Made-to-Order Production
Most Hey Uncle Tuck merchandise is produced on demand by our fulfillment partner, Printful, after you place an order. Because items are made for you, production begins shortly after an order is accepted. Product colors, placement, and appearance may vary slightly from on-screen previews because of monitor settings and normal production differences.
We may update, limit, or discontinue products, designs, colors, or sizes at any time. Product availability is not guaranteed until your order is accepted.
- Pricing and Payment
Prices are shown in U.S. dollars unless stated otherwise. Shipping charges and any applicable taxes are calculated during checkout. We may correct pricing or product-description errors and may cancel an affected order before fulfillment, in which case any captured payment will be refunded.
Payments are processed by third-party payment providers, including WooPayments and PayPal. Their terms and privacy practices may also apply. You authorize us and those providers to charge the payment method you select for the order total.
- Order Acceptance, Changes, and Cancellations
An order confirmation acknowledges that we received your order; it does not guarantee acceptance. We may decline or cancel an order for suspected fraud, payment failure, inventory or production problems, pricing errors, shipping restrictions, or other reasonable business concerns.
Because products are made to order, changes or cancellations may not be possible once production begins. Contact us as soon as possible through https://heyuncletuck.com/ask/ if you need help. We will try to assist, but cannot guarantee a change or cancellation.
- Shipping and Delivery
Shipping estimates are provided at checkout and are not guaranteed delivery dates. Production time is separate from transit time. Delays may occur because of carriers, weather, customs, address problems, high order volume, or events outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. Additional charges caused by an incorrect address, refused delivery, or unclaimed package may be your responsibility where permitted by law. Risk of loss passes as provided by applicable law.
International orders may be subject to customs duties, import taxes, brokerage charges, or other fees imposed by the destination country. Unless checkout states otherwise, those charges are the customer’s responsibility.
- Returns, Refunds, and Damaged Items
Because most products are made to order, we generally do not accept returns or exchanges for buyer’s remorse, an incorrect size selection, or a change of mind, except where required by law.
If an item arrives damaged, defective, misprinted, or materially different from what you ordered, contact us through https://heyuncletuck.com/ask/ promptly and include your order number, a description of the problem, and clear photographs. Please contact us within 30 days after delivery or within 30 days after the estimated delivery date for a package that appears lost. We will review the issue and, when approved, arrange an appropriate replacement or refund.
Do not send products directly to Printful or another address without instructions from us. This section does not limit rights that cannot legally be waived.
- Intellectual Property
Hey Uncle Tuck names, logos, artwork, slogans, product designs, photographs, audio, video, and other creative materials are owned by Lindsey Epps Media LLC, Hey Uncle Tuck, or their respective licensors. Purchasing a product gives you ownership of that physical item for personal use; it does not transfer any intellectual-property rights or permission to reproduce, resell, or commercially exploit the design.
- Acceptable Use
You may not use the store to commit fraud, interfere with store operation, introduce malicious code, scrape or copy store content at scale, violate another person’s rights, or engage in unlawful activity. We may restrict access or cancel orders when reasonably necessary to protect customers, the business, or the store.
- Third-Party Services
The store relies on third parties for hosting, payments, shipping, fulfillment, fraud prevention, analytics, and related services. Those services may have their own terms and policies. We are not responsible for third-party acts or delays beyond our reasonable control, except where applicable law provides otherwise.
- Disclaimers and Limitation of Liability
To the fullest extent permitted by law, the store and products are provided without warranties beyond those expressly stated or required by law. Lindsey Epps Media LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from a purchase or use of the store.
To the fullest extent permitted by law, our total liability relating to an order will not exceed the amount you paid for that order. Some jurisdictions do not allow certain warranty exclusions or liability limitations, so parts of this section may not apply to you.
- Indemnification
To the extent permitted by law, you agree to be responsible for claims, losses, or costs arising from your unlawful misuse of the store, your violation of these terms, or your infringement of another person’s rights.
- Governing Law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where mandatory consumer-protection law in your location applies. Any dispute will be handled in a court with lawful jurisdiction unless the parties agree to another resolution method.
- Changes to These Terms
We may update these terms as the store, laws, or services change. The updated version will be posted here with a revised date. The terms in effect when you place an order generally govern that order.
